The sequestration of expert witnesses falls under Maine’s Rules of Evidence, Rule 615. ME. REV. STAT. ANN. tit. 6, § 615 (2017). This rule allows the court to exclude a witness from the courtroom as to not hear testimony of other witnesses when a party requests or through an order of its own. Id. The rule has three exceptions of individuals that cannot be excluded and expert witnesses fall under the third exclusion. Id. The third exclusion is for “a person whose presence a party shows to be essential to presenting the party’s claim or defense.” Id. The trial court is given discretion as to whether to grant motions for exclusion. State v. Miller, 253 A.2d 58 (Me. 1969).
