Jury instructions regarding expert witnesses in North Dakota are outlined in North Dakota’s Pattern Jury Instructions Civil § C- 80.05. N.D. PATTERN JURY INSTR. CIVIL § C – 80.05 (2010) . This rule explains that individuals labeled as experts have “specialized knowledge that will assist he jury in understanding the evidence.” Id. The jury is instructed that it is not required to accept an expert’s testimony. Id. Instead, the jury should evaluate the testimony the same way that it evaluates the testimony of all witnesses and then give the expert’s testimony the weight it feels it should be given. Id. The jury is permitted to reject the expert’s testimony if it finds that the expert’s testimony is not “based on sufficient knowledge, skill, experience, training, or education.” Id.
