Jury instructions regarding expert witnesses in Alabama are outlined in Alabama Pattern Jury Instructions, Civil rule 15.06. ALA. PATTERN JURY INSTR. 15.06 (2016). This rule instructs the jury to consider the expert’s testimony in light of all other evidence presented, as the expert testimony is to aid the jury in understanding difficult portions of the facts. Id. Further, the rule provides that the jury is not bound to accept the testimony of an expert simply because that person is an expert. Id. The jury should decide how much weight and credibility to afford each expert witness the same way it does for other witnesses. Id. The notes to the rule state that if expert testimony is required “to establish the plaintiff’s case, and the expert testimony is uncontradicted, the jury is bound by the testimony and the instruction must be modified.” Id.
