Expert witness jury instructions in New York are outlined in New York’s Civil Pattern Jury Instructions. N.Y. Pattern Jury Inst. Civil 1:90 (2017). These instructions provide the general instructions to be given to a jury regarding an expert witness and the witness’s testimony. Id. The instructions remind the jury of the expert, what the expert testified to, and alert the jury that it can either accept or reject the testimony of the expert. Id. The instructions note that the jury should weigh all evidence together along with the expert’s qualifications to determine whether to accept or reject the expert’s testimony and opinions. Id. Furthermore, the comments note that expert testimony will only be admitted and considered by the jury if it is within the scope of questioning considered admissible by the trial court. People v.
