Expert witness discovery is governed by Kansas’s Rules of Civil Procedure, Rule 60-226. KAN. STAT. ANN. § 60-226 (West 2017). This rule allows discovery into the compensation that is paid to the expert to testify in said capacity at trial. Id. While case law and the statute do not specifically say whether other financial information is discoverable, case law notes that whether information is discoverable or not is a decision to be made by the trial court. In re Estate of Broderick, 125 P.3d 564 (Kan. Ct. App. 2005).
