Expert witness discovery is governed by Kentucky’s Rules of Civil Procedure, Rule 26.02. KY. REV. STAT. ANN. §26.02 (West 2017). This rule allows the court to order that the fees and expenses regarding the expert’s testimony be discoverable “as the court may deem appropriate.” Id. Case law notes that experts can be questioned as to the percentage of their income that comes from being an expert witness as well as the total amount of income the expert receives from being an expert witness. Primm v. Isaac, 127 S.W.3d 630 (Ky. 2004).
