Discovery regarding expert witnesses is governed by Michigan’s Rules of Civil Procedure, Rule 2.302. Mich. Comp. Laws Ann. § 2.302 (West 2017). This rule allows a party to file a motion for discovery above and beyond what is already required by the rule and gives the court the ability to allow discovery into fees and expenses of expert witnesses. Id. While courts in Michigan allow a wide scope of discovery, the courts have held that requiring disclosure of expert witness financial statements is “unnecessary” and should only be used in situations with “compelling circumstances.” Kincaid v. Croskey, No. 11-004918-NI, 2013 WL 6124289 (Mich. Ct. App. Nov. 21, 2013).
