Expert witness discovery in New Mexico is governed by New Mexico’s Rules of Civil Procedure, Rule 1-026. N.M. STAT. ANN. § 5-1-026 (West 2017). The rule does not specifically note whether an expert’s fees and expenses are discoverable, but it does allow for discovery of the expert witness. Id. Case law does not discuss whether an expert’s financial information is discoverable either, but it does note that there is a “presumption in favor of discovery.” Reaves v. Bergsrud, 982 P.2d 497 (N.M. Ct. App. 1999). Also, the court is given discretion whether to grant discovery requests or not. Board of Com’rs of Dona Ana County v. Las Cruces Sun-News, 76 P.3d 36 (N.M. Ct. App. 2003).
