Expert witness discovery is governed by Utah’s Rules of Civil Procedure, Rule 26. UTAH CODE ANN. § 5-26 (West 2017). This rule requires that parties disclose how much they are paying experts as compensation to testify as an expert. Id. This rule also allows for further discovery of experts by a party above the pieces of information that are required to be disclosed. Id. While case law does not specifically note whether other financial information is discoverable, it does note that the court is given discretion as to whether to allow certain information to be discoverable or not. Baumann v. The Kroger Company, 381 P.3d 1135 (Utah Ct. App. 2016).
