The sequestration of expert witnesses falls under California’s Rules of Evidence, § 777. CAL. EVID. CODE § 777 (West 2017). This rule allows the court to exclude any witness from the courtroom so as to not hear another witness’s testimony unless an exception applies to a witness. Id. There is no exception that applies to experts such that an expert witness would not be sequestered. Id. This is supported by case law, which holds that if an expert is strictly testifying to an opinion, such as a medical opinion, then it is appropriate to have opposing experts sequestered while the other party’s experts are testifying. People v. Maxey, 104 Cal. Rptr. 466 (Cal Ct. App. 1972).
