The sequestration of expert witnesses falls under Colorado’s Rules of Evidence, Rule 615. Colo. Rev. Stat. Ann. § 13-33-615 (West 2017). This rule requires the court to exclude witnesses from the courtroom as to not hear the testimony of other witnesses when requested by a party or when the court orders on its own. Id. The rule has three exceptions and experts fall under the third exception. Id. The third exception is for “a person whose presence is shown by a party to be essential to the presentation of his case.” Id. The trial court is given discretion and if the requesting party does not show the “necessity and feasibility of sequestration” the court can deny the request. People v. Beltran, 634 P.2d 1003 (Colo. App. 1981).
