The sequestration of expert witnesses falls under Nevada’s Rules of Evidence, Rule 50.155. NEV. REV. STAT. ANN. § 50.155 (West 2017). This rule requires the court to exclude a witness from the courtroom as to not hear testimony of other witnesses when requested by a party or through an order of its own. Id. The rule has four exceptions and expert witnesses fall under the third exception. Id. The third exception is for “a person whose presence is shown by a party to be essential to the presentation of that party’s cause.” Id. The trial court is given authority to determine if it is essential that the expert remain in the courtroom. Rainsberger v. State, 350 P.2d 995 (Nev. 1960).
